Complaint Procedures

Ulster BOCES is committed to respecting the rights and dignity of all individuals and to providing a safe, inclusive, and equitable environment. When an individual believes their rights may have been violated, Ulster BOCES has established procedures to address concerns and ensure they are reviewed appropriately. Please review the information below to determine which complaint process applies to your concern.


DASA Complaint

The goal of the Dignity for All Students Act (DASA) is to provide students with a safe, supportive educational environment that is free from discrimination, intimidation, taunting, harassment and bullying. DASA states that no student shall be subjected to harassment or discrimination by employees or students on school property or at a school function based on their actual or perceived race, color, weight, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender, or sex.

A DASA Complaint Form is available for any parent, student, bystander, or victim who would like to file a complaint. The form can be handed in to any Ulster BOCES employee.  

Use this form for student-to-student or employee-to-student incidents involving bullying, harassment, or discrimination in a school setting, which are addressed under DASA.

Discrimination/Harassment Complaint

Ulster BOCES does not discriminate on the basis of an individual’s actual or perceived race, color, creed, religion, religious practice, national origin, ethnic group, sex (including sexual harassment and sexual violence), gender identity, sexual orientation (“sexual orientation” means heterosexuality, homosexuality, bisexuality, or asexuality), political affiliation, age, marital status, military status, veteran status, disability, weight, domestic violence victim status, arrest or conviction record, genetic predisposition or carrier status or any other legally protected status in regard to employment opportunities or educational/vocational programs or activities which it operates. 

Use this form for complaints of discrimination or harassment that do not fall under Title IX or DASA procedures.

Title IX Complaint

Title IX of the Education Amendments Act of 1972 and its implementing regulations (Title IX) prohibit discrimination on the basis of sex in any education program or activity that receives federal financial assistance. As required by Title IX, Ulster BOCES does not discriminate on the basis of sex in its education programs and activities or when making employment decisions.

Under Title IX, sexual harassment means conduct on the basis of sex that satisfies one or more of the following: An employee of Ulster BOCES conditioning the provision of an aid, benefit, or service on an individual's participation in unwelcome sexual conduct; Unwelcome conduct determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the BOCES’ education program or activity; or Sexual assault, dating violence, domestic violence, or stalking.

Use this form if the concern involves sexual harassment, sexual violence, or sex-based discrimination involving a student or employee, which must be addressed under federal Title IX procedures.
